3. User Accounts

3.1 Account Creation

To use our Service, you must register for an account. You agree to:

• Maintain the security of your password
• Accept responsibility for all activities under your account

3.2 Account Eligibility

4. Subscription and Payments

4.1 Free Trial

We may offer a free trial period. During the trial, you have access to all features. At the end of the trial, you must subscribe to continue using the Service.

4.2 Subscription Plans

Our Service is offered through subscription plans with different features and pricing. You agree to pay all fees associated with your chosen plan.

4.3 Billing

• Subscriptions are billed in advance on a monthly or annual basis
• Payments are processed through Stripe, our payment processor
• You authorize us to charge your payment method on file
• All fees are non-refundable unless otherwise stated
• Prices are subject to change with 30 days notice

4.4 Payment Processing Fees

When you process customer payments through our platform, we may charge a platform fee. Standard payment processing fees apply as determined by our payment processor.

4.5 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will retain access to the Service until the end of the paid period.

5. Acceptable Use

5.1 Permitted Use

You may use our Service only for lawful purposes and in accordance with these Terms.

5.2 Prohibited Activities

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws

7. Intellectual Property

The Service, including its original content, features, and functionality, is owned by atPlumb and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your business purposes.

atPlumb name, logo, and related marks are trademarks of atPlumb. You may not use these marks without our prior written permission.

8. SMS Terms

By using our SMS features, you agree to our SMS Terms of Service, which include:

• You will obtain proper consent before sending SMS to customers
• You will comply with TCPA and other SMS regulations
• You will not send spam or unsolicited messages
• Standard message and data rates apply
• Recipients can opt out at any time by replying STOP

9. Data Backup and Loss

While we regularly backup data, you are responsible for maintaining your own backups of critical business information. We are not liable for any data loss that may occur.

10. Third-Party Services

Our Service integrates with third-party services (Stripe, Twilio, etc.). Your use of these services is subject to their respective terms of service. We are not responsible for third-party services.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• The results obtained from use of the Service will be accurate or reliable
• The quality of any products, services, or information will meet your expectations
• Any errors in the Service will be corrected

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATPLUMB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months prior to the claim.

13. Indemnification

You agree to indemnify and hold harmless atPlumb and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your User Content

14. Termination

14.1 Termination by You

You may terminate your account at any time by contacting us or using account settings.

14.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice, if you breach these Terms.

14.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. You may request a copy of your data within 30 days of termination. After 30 days, we may delete your data.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

16. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except that either party may seek injunctive relief in court for violations of intellectual property rights.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Service. Your continued use of the Service after changes constitutes acceptance of the new Terms.

18. Severability

If any provision of these Terms is found to be unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full effect.

19. Entire Agreement

These Terms constitute the entire agreement between you and atPlumb regarding the Service and supersede all prior agreements and understandings.
